Affiliate program terms

The program is open to Captivaq customers: anyone who is a member of a workspace with an active paid subscription. You join by turning on your referral link in the app. Doing so means you accept these terms, alongside the Terms of service, which keep applying to your own use of the product.

Your participation is tied to that subscription. While it is active, your link earns. If it lapses, is cancelled or is suspended for non-payment, no new commissions accrue from the end of the period you paid for until it is active again. Commissions that were already earned and approved are still paid.

We may decline or remove anyone from the program, with a reason, where we believe the rules in section 5 have been broken or where the referrals do not look like real customers.

You get a referral link and a referral code. When someone opens your link we set a cookie in their browser for 60 days. If they create a Captivaq account and a workspace within that window, that workspace is attributed to you. Where more than one affiliate link was clicked, the last one before signup wins.

Attribution is fixed when the workspace is created. It does not transfer later, and a workspace that already exists before the click cannot be attributed to anyone. A referred customer who clears their cookies, uses a different browser or signs up outside the window is not attributed, and we cannot add them by hand afterwards.

The following do not count as referrals: your own workspaces, workspaces of people who are already members of a workspace you belong to, and anyone who was already a Captivaq customer.

You earn 50% of every subscription payment a referred workspace makes to us, monthly or annual, for as long as that workspace stays subscribed and your own subscription stays active. The percentage is taken from the amount we actually receive, after any discount or credit applied to the customer and before the taxes we collect on top. Payment processing fees are not deducted.

A commission is earned when the referred customer's payment clears, and becomes payable 30 days later. If that payment is refunded, charged back or reversed inside the hold, the commission is cancelled. If it is reversed after a payout, the amount is deducted from your next payout.

The referred customer pays the standard price. There is no discount attached to the referral, and you may not offer one, pass on part of your commission or describe the link as a coupon.

Commissions are paid through Stripe. Before your first payout you connect a Stripe account from the referrals page in the app; Stripe collects the identity, tax and bank details it requires and holds them, and we never see your bank account. Stripe may decline or pause payouts to an account that does not meet its requirements, and payouts wait until it is satisfied.

Payable commissions are transferred on the first day of each month, in US dollars, once your balance reaches $50. Below that, the balance carries over to the next month. Stripe pays the money on to your bank on its usual schedule and lists every payout in the dashboard it gives you.

The balance shown in the app is the record. If you believe it is wrong, email contact@logestalabs.com within 60 days of the payout in question and we will look at it. Any fees charged by your bank or by Stripe for currency conversion are yours.

Promote Captivaq the way you would want to be sold to. In particular, you may not:

• Run paid search or social ads on the Captivaq name, our product names, or close misspellings of them, or send ad traffic to our domains.
• Send unsolicited email, messages or comments carrying your link.
• Make claims about the product, its coverage, its results or its pricing that our own pages do not make.
• Present yourself as Captivaq, or register domains, handles or pages that could be taken for ours.
• Place your link on sites with illegal, hateful or misleading content, or use cookie stuffing, forced clicks, bots or any other means of creating attribution without a real choice by the visitor.
• Refer yourself, your own company or anyone you control, or share the commission with the customer you refer.

Where you recommend Captivaq to your audience, say that you earn a commission. In the United States the FTC requires that disclosure; it is good practice everywhere.

You can leave the program at any time by turning your link off in the app or emailing contact@logestalabs.com. Commissions earned and approved up to that point are paid on the next payout date that follows the hold; nothing accrues afterwards.

We can remove you from the program, on notice, if you break these terms or the Terms of service, if your referrals turn out to be fraudulent or self-referrals, or if we end the program. A breach forfeits unpaid commissions. Ending the program does not: earned commissions are paid out, and we will give at least 30 days' notice before the program closes.

You are an independent promoter, not an employee, agent or partner of Logesta Labs LLC. You cannot make promises on our behalf, and you are responsible for your own taxes on what we pay you. You may use the Captivaq name and logo only to identify the product you are recommending, in the form we publish on the press page, and that permission ends with your participation.

Sections 13 through 16 of the Terms of service, on disclaimers, limitation of liability, indemnity and governing law, apply to this program as if written here.

We may change the commission rate, the attribution window, the hold, the minimum payout or any other part of these terms. We will email active affiliates at least 30 days before a change takes effect, and a change applies to payments made after that date. Commissions on payments made before the change are calculated at the old rate. If you do not agree with a change, turn off your link before it takes effect.
